Terms of Service
The rules and conditions for using MySalon25.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and MySalon25 ("we", "us", "our"), a platform operated from Belgium. By creating an account or using our platform, you agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use our services. These Terms are governed by Belgian law.
1. Definitions
"Platform" means the MySalon25 web application, including the marketing website, back office management portal, and appointment booking system. "Salon Owner" means a professional user who registers a salon and manages it through the Platform. "Team Member" means a person added by a Salon Owner to work on the salon's schedule. "End Customer" means a client of a Salon who books appointments through the Platform. "Subscription" means the recurring paid plan chosen by the Salon Owner. "Content" means all data, text, images, and materials uploaded to or generated through the Platform.
2. Acceptance & Eligibility
By accessing or using MySalon25, you confirm that: (a) you are at least 18 years old; (b) you have the legal capacity to enter into a binding agreement; (c) if acting on behalf of a business entity, you have the authority to bind that entity to these Terms; and (d) you will use the Platform in compliance with all applicable Belgian and European Union laws and regulations, including Book VI of the Belgian Code of Economic Law (market practices and consumer protection). We reserve the right to refuse service to anyone at our sole discretion.
3. Description of Services
MySalon25 provides a cloud-based salon management platform that enables Salon Owners to: manage appointment scheduling and online booking; organize team members and working hours; manage services and pricing; communicate with customers via email; process payments through integrated payment providers; and access business dashboard and analytics. The specific features available depend on your Subscription plan. We reserve the right to modify, add, or remove features at any time, provided that material changes affecting paid Subscriptions will be communicated with reasonable advance notice.
4. Account Registration & Obligations
You are responsible for: (a) providing accurate, complete, and current registration information; (b) maintaining the confidentiality of your login credentials; (c) all activities that occur under your account; and (d) notifying us immediately of any unauthorized use. You may not: share your account credentials with unauthorized persons; create multiple accounts to circumvent restrictions; or use another person's account without permission. We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or remain inactive for more than 12 consecutive months.
5. Subscription & Payment
Paid Subscriptions are billed monthly in advance through our payment provider Mollie B.V. All prices are in euros and exclusive of VAT unless stated otherwise. VAT is charged at the applicable Belgian or EU rate. By subscribing, you authorize recurring payments for the selected plan. Subscriptions renew automatically unless cancelled before the end of the current billing period. No refunds are provided for partial months or unused periods, except where required by mandatory Belgian consumer protection law (Book VI, Code of Economic Law). We reserve the right to change our pricing with at least 30 days' written notice. If you do not agree to a price change, you may cancel your Subscription before the new price takes effect. Failure to pay may result in suspension or termination of your account.
6. Acceptable Use
You agree not to use MySalon25 to: (a) violate any applicable law, regulation, or third-party right; (b) upload or distribute malicious software, viruses, or harmful code; (c) attempt unauthorized access to our systems, other user accounts, or data; (d) send unsolicited communications (spam) through the platform; (e) store or transmit content that is unlawful, defamatory, obscene, or infringes intellectual property rights; (f) use the platform for any purpose other than salon and beauty business management; (g) scrape, crawl, or extract data from the platform through automated means; or (h) interfere with or disrupt the integrity or performance of the platform. Violation of these terms may result in immediate account suspension or termination without prior notice.
7. Intellectual Property
All intellectual property rights in the MySalon25 platform — including but not limited to software, design, trademarks, logos, documentation, and user interface — are and remain the exclusive property of MySalon25. Your Subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the platform for its intended purpose during your active Subscription period. You may not copy, modify, reverse-engineer, decompile, or create derivative works of any part of the platform. You retain ownership of Content you upload to the platform. By uploading Content, you grant MySalon25 a limited license to host, store, and display that Content solely for the purpose of providing the services.
8. Data & Privacy
Your use of MySalon25 is also governed by our Privacy Policy, which describes how we collect, use, and protect personal data. Salon Owners acknowledge that they act as data controllers for the personal data of their End Customers and Team Members processed through the platform, and must comply with GDPR and applicable Belgian data protection laws. MySalon25 acts as a data processor on the Salon Owner's behalf. You are responsible for obtaining any necessary consents from your customers and for providing them with appropriate privacy notices.
9. Service Availability
We strive to provide a reliable and available platform, but we do not guarantee uninterrupted or error-free operation. The platform is provided on a "best effort" basis. We may temporarily suspend access for maintenance, updates, or security reasons. Planned maintenance will be communicated in advance when reasonably possible. We shall not be liable for any loss, damage, or inconvenience caused by downtime, whether scheduled or unscheduled, including but not limited to lost appointments, lost revenue, or data unavailability.
10. Limitation of Liability
To the maximum extent permitted by Belgian law (including Article 5.89 of the Belgian Civil Code): (a) MySalon25's total aggregate liability arising from or related to these Terms or the use of the platform shall not exceed the total Subscription fees paid by you in the 12 months preceding the event giving rise to the claim; (b) in no event shall MySalon25 be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunities, business interruption, or reputational harm; (c) MySalon25 shall not be liable for actions, omissions, or Content of Salon Owners, Team Members, or End Customers; and (d) MySalon25 shall not be liable for any failure or delay caused by circumstances beyond our reasonable control. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under mandatory Belgian law.
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE MAXIMUM EXTENT PERMITTED BY BELGIAN LAW. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that: (a) the platform will meet your specific requirements; (b) the platform will be uninterrupted, timely, secure, or error-free; (c) the results obtained from use of the platform will be accurate or reliable; or (d) any errors will be corrected. This disclaimer does not affect your statutory rights as a consumer under mandatory Belgian or EU consumer protection law where applicable.
12. Indemnification
You agree to indemnify, defend, and hold harmless MySalon25, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use or misuse of the platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your Content or data uploaded to the platform; or (e) your infringement of any third-party right, including intellectual property, privacy, or data protection rights. This indemnification obligation shall survive termination of your account and these Terms.
13. Termination
You may cancel your Subscription and close your account at any time through the platform's settings. Cancellation takes effect at the end of the current billing period; no pro-rata refunds are given for the remaining period. We may suspend or terminate your account immediately and without prior notice if: (a) you breach any provision of these Terms; (b) you fail to pay Subscription fees; (c) we are required to do so by law; or (d) we reasonably believe your use poses a security risk. Upon termination: your access to the platform ceases immediately; we will retain your data for a period consistent with our Privacy Policy and legal obligations; you may request export of your data within 30 days of termination. Sections on Intellectual Property, Limitation of Liability, Indemnification, Governing Law, and any other provisions which by their nature should survive, shall survive termination.
14. Force Majeure
MySalon25 shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, wars, civil unrest, cyberattacks, power outages, internet disruptions, failures of third-party service providers, or changes in applicable law or regulation. If a force majeure event continues for more than 90 consecutive days, either party may terminate these Terms by written notice.
15. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the platform shall be submitted exclusively to the competent courts of Brussels, Belgium. Notwithstanding the foregoing, if you qualify as a consumer under EU Directive 2011/83/EU, you may benefit from any mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your domicile. Nothing in these Terms affects your right to rely on any applicable mandatory local law that cannot be derogated from by agreement.
16. Modifications to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' prior written notice of material changes via email or a prominent notice on the platform. Your continued use of MySalon25 after the effective date of the revised Terms constitutes acceptance of the changes. If you do not agree with the modified Terms, you must stop using the platform and cancel your Subscription before the changes take effect.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent and economic effect, to the extent permitted by Belgian law.
